Terms & Conditions

DARK OPS FISHING – TERMS & CONDITIONS


These Terms & Conditions (“Agreement”) govern all bookings and services provided by Dark Ops Fishing (“Company”, “we”, “us”, “our”) to the client (“Client”, “you”).


By booking a trip, the Client agrees to the following:

1. Bookings & Payment
A deposit is required to secure all bookings
Full payment must be made prior to or on the day of the trip (as specified at booking)
Bookings are not confirmed until a deposit is received

2. Cancellation & Refund Policy
14+ days notice: 100% refund
7–13 days notice: 75% refund
4–6 days notice: 50% refund
48 hours notice: 25% refund
Less than 48 hours or no-show: No refund
Refunds apply to deposits and/or full payments
All cancellations must be made directly with the Company

3. Weather Policy
Trips may be rescheduled or canceled due to unsafe weather conditions at the Company’s discretion
If canceled by the Company due to weather:
Clients will receive a full refund OR option to reschedule
Light rain or non-dangerous conditions do not qualify for cancellation

4. Client Responsibilities
Clients agree to:
Arrive on time at the designated meeting location
Follow all safety instructions provided by the guide
Treat equipment and property with respect
Comply with all fishing regulations in Manitoba
Failure to comply may result in termination of the trip without refund.

5. Safety & Conduct
Life jackets must be worn when required
No drugs permitted
No alcohol permitted on boats
Alcohol consumption in the ice castle must be responsible and may be restricted at the guide’s discretion
Unsafe or aggressive behaviour will result in immediate termination of the trip without refund

6. Assumption of Risk
Fishing and boating involve inherent risks, including but not limited to:
Water hazards
Weather conditions
Equipment-related injuries
By participating, the Client acknowledges and accepts these risks.

7. Liability Waiver
All participants must sign the Liability Waiver prior to the trip.
Dark Ops Fishing, its owners (Elias Penner and Cameron Hofsiss), employees, and affiliates are not liable for:
Injuries
Loss or damage to personal property
Accidents occurring during the trip
To the fullest extent permitted by law.

8. Equipment Use
All equipment provided remains property of the Company
Clients may be held responsible for damage caused by misuse or negligence

9. Fishing Licenses
Clients are responsible for obtaining a valid fishing license where required under Manitoba law

10. Photography & Media
Photos and videos may be taken during trips
The Company reserves the right to use this content for marketing and promotional purposes
Clients may request exclusion in writing prior to the trip

11. Right to Refuse Service
The Company reserves the right to refuse or terminate service if:
Safety is at risk
Terms are violated
Behaviour is deemed inappropriate
No refund will be issued in such cases.

12. Changes to Services
The Company reserves the right to modify trip details due to weather, safety, or operational needs

13. Governing Law
This Agreement is governed by the laws of Manitoba and applicable Canadian laws.

14. Agreement
By booking a trip, the Client confirms they:
Have read and understood these Terms & Conditions
Agree to be bound by them
